What Is Conservatorship?
Conservatorship is a legal arrangement. This process appoints an individual or organization, known as a “conservator.” The person requiring assistance is the “protected person.”
The conservator’s job is to manage the personal or financial affairs of someone who cannot do so themselves.
Conservatorship is generally reserved for people facing disability, injury, illness, or aging-related challenges that impact their decision-making. This arrangement helps protect those who are vulnerable due to their incapacity. While guardianship offers a way to handle a protected person’s personal, medical and health decisions, a conservatorship in Oregon is instituted specifically for managing a protected person’s financial affairs.
Courts carefully evaluate the circumstances to appoint conservators who can handle these responsibilities with care and diligence. Conservatorship helps protect people from harm, neglect, or exploitation.
What is a Conservator?
A conservator is a court-appointed fiduciary appointed to administer the property of an adult who requires protection. A conservator generally takes possession of all property of substantial value belonging to the protected person, while allowing the protected person to retain control of funds needed for daily living as appropriate. The Court can only appoint a conservator if there is clear and convincing evidence that the person is financially incapable, and has money or property that requires management or protection.
Temporary Conservatorships
Oregon law provides for the appointment a temporary fiduciary in urgent situations when there is an immediate and serious danger to the person’s estate or which requires immediate action to protect the person’s welfare.
These arrangements are only made for a specific purpose, and the appointment is limited to 30 days (although it can be extended for good cause shown). Temporary conservatorships are useful when there is an emergency that requires immediate action, with the goal of preserving the property of the protected person through another method within a relatively short amount of time, but where long-term measures to protect the person’s other property are already in place.
